Terms of Service

These Terms of Service ("Terms") govern the use of the AthleteDock software platform (the "Platform") operated by AthleteDock Ltd., a company registered in Bulgaria ("Platform Provider", "we", "us", or "our").

By creating an account or using the Platform, the Organization ("Customer", "Organization", "you") agrees to these Terms.

Service Description

The Platform provides software tools that allow sports organizations to manage administrative and operational activities including player records, coach management, scheduling, and communication.

The Platform acts solely as a technical service provider and does not determine how Organizations use the Platform or what personal data they collect.

Account Registration

Organizations must create an account to use the Platform. The Organization is responsible for:

  • Maintaining the confidentiality of administrator credentials

  • Managing user permissions within its workspace

  • All activities conducted under its account

The Organization must ensure that information provided during registration is accurate.

Organization Ownership of Data

All data uploaded or entered into the Platform by an Organization remains the property and responsibility of that Organization.

The Platform Provider does not claim ownership of such data.

Data Protection Roles

For the purposes of Regulation (EU) 2016/679 (General Data Protection Regulation – "GDPR"):

  • The Organization acts as the Data Controller for personal data processed through the Platform.

  • The Platform Provider acts as a Data Processor, processing data only on behalf of the Organization and according to the Organization's instructions.

Processing of personal data is governed by the Data Processing Agreement (DPA) included in these Terms.

Organization Responsibilities

The Organization is solely responsible for ensuring that its use of the Platform complies with applicable laws, including data protection laws.

This includes responsibility for:

  • Obtaining lawful consent where required

  • Providing privacy notices to players, parents, and staff

  • Obtaining parental or guardian consent where minors are involved

  • Ensuring the accuracy of data entered into the Platform

  • Responding to requests from data subjects (access, correction, deletion)

Acceptable Use

Organizations must not use the Platform to:

  • Process personal data unlawfully

  • Upload malicious software

  • Attempt to gain unauthorized access to other organizations' data

  • Interfere with the security or operation of the Platform

Sub-processors

The Platform Provider may use third-party service providers to deliver the Platform.

These providers may include infrastructure, hosting, database, or communication services. A current list of sub-processors is provided in the Data Processing Agreement.

Security

The Platform Provider implements reasonable technical and organizational measures designed to protect data from unauthorized access, loss, or alteration.

However, the Organization is responsible for managing user access within its workspace.

Service Availability

The Platform Provider aims to provide reliable service but does not guarantee uninterrupted availability.

Maintenance, updates, or technical issues may temporarily affect service availability.

Termination

Organizations may terminate their account at any time.

Upon termination, data will be deleted or returned in accordance with the Data Processing Agreement.

Limitation of Liability

To the maximum extent permitted by law, the Platform Provider shall not be liable for the legality of data processed by Organizations through the Platform.

The Platform Provider's total liability arising from the use of the Platform shall not exceed the total fees paid by the Organization during the previous twelve months.

Governing Law

These Terms shall be governed by the laws of Bulgaria.

Disputes arising from these Terms shall be subject to the jurisdiction of the competent courts in Bulgaria.
